These Terms of Service ("Terms") govern your use of the Pitchwits website and platform operated by Pitchwits Ltd ("Pitchwits", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms, our Privacy Policy, and our AI Transparency disclosures.
1. Services
Pitchwits provides funding advisory services and an AI-assisted platform for R&D-heavy tech startups. Our services include grant application drafting, fundraising strategy, pitch deck development, and due diligence preparation.
2. Account Registration
To use the Pitchwits platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Submit false or misleading information in grant applications or company profiles
- Attempt to gain unauthorised access to the platform or other users' data
- Interfere with or disrupt the service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the platform
- Use the platform to develop competing products or services
4. Intellectual Property
Content you create on the platform (grant applications, documents, etc.) remains your intellectual property. You grant Pitchwits a limited licence to process, store, and display your content as necessary to provide the service.
The Pitchwits platform, including its design, features, and underlying technology, is owned by Pitchwits Ltd and protected by intellectual property laws.
5. AI Processing Agreement
5.1 AI-assisted content generation
Our platform uses AI models provided by Anthropic (Claude) and Google (Gemini) to generate, assess, and refine grant application content. By using the platform, you acknowledge and agree that your inputs (questionnaire responses, uploaded documents, and edits) will be sent to these AI providers for processing.
5.2 AI output disclaimer
AI-generated content is provided as a draft for your review and editing. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or omissions. You are responsible for reviewing, verifying, and approving all AI-generated content before submission to any funding body. Pitchwits does not guarantee the accuracy, completeness, or success of AI-generated applications.
5.3 No automated decision-making
AI is used as an assistive tool only. No decisions about your eligibility, funding outcomes, or account status are made solely by automated means. All AI outputs are subject to human review and editorial control.
5.4 Sub-processor data handling
Data sent to AI providers via their paid APIs is processed under their respective data processing agreements. Neither Anthropic nor Google use data submitted via their paid APIs to train their foundation models.
6. Training Data
6.1 Optional opt-in
Pitchwits may offer you the option to allow anonymised versions of your inputs and AI outputs to be used for improving our AI models through reinforcement learning from human feedback (RLHF). This is entirely optional and requires your explicit consent.
6.2 Anonymisation
Any data included in training datasets is anonymised before use. Company names, personal names, and other identifying information are removed or replaced so that the data cannot be traced back to you or your organisation.
6.3 Withdrawal
You can withdraw your training data consent at any time via your Privacy Settings. Withdrawal takes effect immediately for future datasets. Data already included in a completed training run cannot be retroactively removed but will be excluded from all subsequent datasets.
7. Your Data Rights
Under GDPR, you have extensive rights over your personal data including the right to access, rectify, erase, and port your data. You can exercise many of these rights directly from your Privacy Settings page, where you can download your data, manage consents, and request account deletion. 8. EU AI Act Transparency
8.1 Risk classification
Under the EU AI Act, our AI system is classified as limited-risk. It is a content-generation tool that assists humans in drafting grant applications. It does not make autonomous decisions, assess creditworthiness, or perform any high-risk function as defined by Annex III of the EU AI Act.
8.2 Transparency obligations
In accordance with Article 50 of the EU AI Act, we inform you that content generated on the Pitchwits platform is produced with the assistance of AI. For detailed information about the AI models used, their capabilities, limitations, and our human oversight processes, see our AI Transparency page.
8.3 Human oversight
All AI-generated content goes through a multi-stage review process: AI generates a draft, automated quality assessment identifies areas for improvement, and you review and edit the final content before any submission. No AI output leaves the platform without your explicit approval.
9. Payments and Subscriptions
Certain features require a paid subscription. Payments are processed by Stripe. Subscription terms, pricing, and cancellation policies are presented at the time of purchase.
10. Limitation of Liability
Pitchwits provides advisory tools and services but does not guarantee funding outcomes. To the maximum extent permitted by law, Pitchwits shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to damages arising from reliance on AI-generated content.
11. Termination
We may suspend or terminate your access to the platform if you breach these Terms. You may close your account at any time via your Privacy Settings or by contacting us. Account deletion is subject to a 30-day grace period during which you can cancel the request.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the platform via our re-consent mechanism. Where changes affect your data rights or AI processing, we will require your renewed consent before continued use.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
